Terms of Service

These Terms govern your use of PixelMagic (the “Service”), an AI background-removal tool operated by [Legal entity name], [Registered address], India (“we”, “us”). By creating an account or using the Service you agree to these Terms.

1. The Service

PixelMagic removes backgrounds from images you upload, using AI models we host. The Service is provided through our website, API, command-line tool and plugins for third-party applications.

2. Accounts

You must provide a valid email address and are responsible for activity under your account and for keeping your API keys secret. You must be at least 18 years old, or have consent from a parent or guardian.

3. Credits and billing

The Service runs on credits. One credit processes one high-resolution image. Credits are purchased as packs or included in a monthly plan, are non-transferable, and expire 12 months after purchase unless stated otherwise. Prices are shown in your local currency for convenience and charged in INR. Applicable taxes (including GST) may be added.

If a job fails on our side, the credit is automatically refunded to your balance.

4. Your content

You keep all rights to the images you upload. You grant us a limited licence to process, store and transmit them solely to provide the Service. We do not use your images to train models or sell them. You confirm you have the rights to any image you upload.

5. Acceptable use

You may not use the Service to process content that is unlawful, infringes others’ rights, depicts child sexual abuse material, or is used to harass, deceive or impersonate. You may not attempt to reverse-engineer, overload or circumvent limits of the Service, or resell it as a substantially identical product without written permission.

6. Availability

We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend or discontinue features with reasonable notice.

7. Intellectual property

The Service, its software, branding and content are owned by us or our licensors. PixelMagic is built on the open-source Lucida model, used under its MIT licence.

8. Liability

To the maximum extent permitted by law, the Service is provided “as is”. Our aggregate liability for any claim is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect or consequential losses.

9. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that breach these Terms. Unused credits are handled under our Refund & Cancellation Policy.

10. Governing law

These Terms are governed by the laws of India, and the courts of [City], India have exclusive jurisdiction.
